COOKIES POLICY - INFORMATIVE EX ART 13 EU Regulations 2016/679 (GDPR)

PREAMBLE

On this page, RGI S.p.A., whose registered office is located in (20124) Milan, Via S. Gregorio, 34, (the "Data Controller") provides information on procedures for managing the site with regards to the processing of personal data belonging to users consulting it by means of direct access from the home page or otherwise from pages inside the site. This privacy policy statement is also provided pursuant to article 13 of legislative decree nº 196 of 30 June 2003, (Code governing the protection of personal data, hereinafter "Code") to those interacting with the Data Controller's web services, accessible via internet at the address www.rgigroup.it or www.rgigroup.com and it is also an extended privacy policy statement pursuant to the Data Protection Authority Decision Identification of simplified procedures for providing the privacy policy statement and for obtaining consent to the use of cookies - 8 May 2014 [web document nº 3118884].

It refers exclusively to this site and not to any other sites consulted by the user through links.

When the user browses the site, data may be gathered referring to identified or identifiable persons, in accordance with the procedures described below.

THE DATA CONTROLLER

Browsing data
With regards to cookies, the Data Controller states that reference should be made to the provisions set out below; and informs users that the computer systems and software procedures put in place to enable this website to function, during normal use, acquire certain personal data, the transfer of which is implicit in the use of internet communication protocols. This is information which has not been collected in order to be associated to identified data subjects, but which by its very nature could, through processing and associations with data held by third parties, make it possible to identify users. IP addresses or the domain names of computers used by users connecting to the site, URI (Uniform Resource Identifier) addresses for requested resources, the time of requests, the method used to submit the request to the server, the dimension of the file obtained as a response, the numerical code indicating the status of the response given by the server (successful, error etc) and other parameters relating to the operating system and to the user's computer environment fall into this category. This data is used in order to obtain information on site use and on preferences shown by users within the framework of their online browsing activity and in order to check that the system functions correctly. The data that is collected could be used for establishing liability in the event of any computer crimes against the site; subject to this eventuality, the data on web contacts shall be kept for the timeframe strictly required for the Data Controller's purpose.

Data provided directly by the user
The optional, explicit and voluntary sending of electronic mail to the addresses indicated in the site entails subsequent acquisition of the sender's address; this is necessary in order to reply to requests, in addition to any other personal data included in the mail (such as for example when information or clarification is requested, writing to the email addresses present on the site). Specific summary information statements will be progressively reported or viewed in the pages of the site prepared for particular services subject to a request, which may entail the processing of personal data (such as, including but not limited to, the provision of personal data by means of forms or similar procedures, as may be contemplated in sections of this site, means that data provided are processed in order to meet users requests; such as for example when curriculum vitae are sent speculatively in order to put oneself forward as a candidate).

COOKIES

Some general information is provided below on cookies in order to assist understanding of the Data Controller's extended privacy policy statement regarding this matter. Cookies are strings of small-size text which the sites visited by users send to the terminal (usually to the browser) where they are stored before being sent back to the same sites on the user's subsequent visit. When browsing a site, a user may also receive cookies on his terminal which are sent by other sites or by web servers (being known as "third parties"), where a number of elements may reside (such as for example, images, maps, sounds, specific links to pages of other domains, present on the site which the user is visiting. Cookies, many of which are usually present in users' browsers, sometimes remaining for a long time, are used for different purposes: performing IT authentication, session monitoring, storing information on specific configurations regarding users accessing the server etc. In its Decision of 8 May 2014 governing the matter the Data Protection Authority identified two macro categories: "technical" cookies and "profiling" cookies.

Technical cookies are those which are used solely for purposes of "ensuring the transmission of a communication to an electronic communications network, or to the extent that it is strictly necessary, to the provider of an information service which is explicitly requested by the contracting party or by the user in order to provide such service" (refer to article 122, paragraph 1 of the Code). They are not used for other purposes and are normally installed directly by the Data Controller or by the website manager. They can be subdivided into browsing cookies or session cookies, which guarantee normal browsing or use of the website (for example making it possible to make a purchase or to authenticate oneself in order to access private areas); analytics cookies, treated the same as technical cookies when used directly by the site manager in order to gather information in an aggregate manner, on the number of users and how these uses visit the site; function cookies allowing users to browse according to a series of selected criteria (for example the language, products selected for purchasing) in order to improve the service provided to the user. For the installation of these cookies there is an obligation to provide the privacy policy statement pursuant to article 13 of the Code, whilst the users' prior consent is not requested.

Profiling cookies are designed to create profiles relating to users and are used in order to send advertising messages in line with the preferences shown by users as they browse online. Due to their possible invasive nature, affecting users' private spheres, European and Italian legislation provides that users must be suitably informed as to the use of same and must express their valid consent (see article 122, I paragraph, of the Code).

Specific and analytical description of the characteristics and the purposes of cookies installed by the site

On this site there are technical operational cookies required for browsing the site and which provide essential functions such as managing a browsing session.

In order to ensure the utmost transparency, a series of technical cookies is listed below in addition to cases of specific use on the site:

Cookies installed directly on the user's/contracting party's terminal (which shall not be used for other purposes) such as for example session cookies. These cookies are not persistent and shall be deleted when the browser is closed.

Cookies used for statistically analysing access/visits to the site (cookies referred to as "analytics") which have solely statistical purposes (and not profiling or marketing purposes as well) and gather information in an aggregate form without any possibility of identifying a specific user. The site uses a Google Analytics statistical analysis system. In these cases, due to the fact that legislation in force requires that for analytics cookies the data subject is provided with clear, appropriate information on the simple procedures for opting out from their use (including possible cookie anonymization mechanisms), the Data Controller specifies that it is possible to proceed to deactivate Google Analytics as follows: users must open their browser, select the settings menu, click on the internet options, open the page relating to privacy and choose the desired level of cookie blockage. Should the user wish to delete cookies already stored it is sufficient to open the security page and deletes the chronology, ticking the "delete cookies" box.

Below, the Data Controller refers to the possibilities for users (pursuant to article 122, paragraph 2 of the Code) to express their options regarding the use of cookies by this site, also through browser settings and the Data Controller also indicates procedures to be adopted in order to configure these settings. NATURE OF DATA PROVISION

Apart from information regarding browsing data and cookies, users are free to provide personal data set out in request forms or indicated in contacts with the Data Controller for requesting information and for other communications etc. Failure to provide such information may make it impossible to achieve the purpose.

 

 

MANNER OF PROCESSING

Personal data is processed by means of automated tools, for the timeframe strictly necessary in order to achieve the purpose of data collection. Technical type data is stored on the Data Controller's servers. Specific security measures are complied with in order to avoid the loss of data, unlawful or incorrect use and unauthorised access.

DATA SUBJECT'S RIGHTS

The data subject may assert his or her rights as expressed by articles 7, 8, 9, 10 and 130 of the Code by contacting the Data Controller and on behalf of the Data Controller the Data Processor responsible for privacy whose registered offices are in (20124) Milan, Via S Gregorio, 34, email address . In particular, according to article 7, data subjects may obtain confirmation of whether or not personal data regarding them exist, even if data is not yet recorded, and the intelligible communication of same.

The data subject is entitled to obtain information:
a) as to the source of their personal data;
b) the purposes and manner of processing;
c) the rationale applied in the event of data processing by means of electronic tools;
d) details to identify the data controller, data processors and the designated representative pursuant to article 5, paragraph 2;
e) parties or categories of parties to which personal data may be sent or which may gain knowledge in their capacity as designated representative in the state territory, as data processor or persons in charge of processing.


The data subject is entitled to obtain:
a) updating, correction or otherwise, when they so desire it, completion of data;
b) deletion, anonymization or freezing of data processed in breach of law, including data which it is not necessary to store with regard to the purposes for which data has been processed or is to be processed subsequently;
c) certification that operations as per sub paragraphs a) and b) have been brought to the attention, also with regard to the content, of all those to whom the data has been sent or distributed, barring cases in which such obligation proves to be impossible or entails the use of resources which are patently out of proportion to the rights being protected.

The data subject is entitled to raise objection, either wholly or partially:
a) for legitimate reasons, to the processing of their personal data, albeit pertinent to the purpose of data collection;
b) to the processing of personal data concerning them for the purposes of sending advertising or direct sales material or for carrying out market research or commercial communications.

With regard to cookies, reference must be made to the provisions set out above; for third party cookies, reference must be made to updated links, to the privacy policy statements and to the third party consent forms. It should be recalled that it is possible, as stated above, for users (pursuant to article 122, paragraph 2, of the Code) to express their options regarding the use of cookies by the site, also by changing their browser settings.
